A non-conforming property refers to the one that does not pass the current zonal ordinances because of the existence of the property prior to the devised current ordinances.
Non-conforming use is usually exempted from the zonal criteria as the conflicting changes were made by the previous owner. The non-conforming title could be removed by applying formally a request to the respective zoning ordinance which could incur some reasonable cost and time.
Discontinuing Non-conforming Use
The discontinuance of the non-conforming use could be either intentional or by itself. The owner could wish to end the non-conforming use and thus apply for the same within the jurisdiction period.
It is also possible that the non-conforming use is terminated when the property is destroyed or damaged more than 50%. In that case, the owner cannot rebuild the same to get the non-conforming use.
There are also chances to amortize the current value of the non-conforming over a period of time. Once the value hits zero, the use comes to an end. This option is very restricted and not available easily.
