Learning how to understand Eminent Domain is easy once it is explained properly. Many people haven’t heard of what an Eminent Domain is until it starts to affect them. This is why many people have negative feelings toward the law.
Eminent Domain basically states that the federal or state government has the right to seize any privately owned property as long as it is for public use and the owner is compensated. It is based off of the Trust Law, which was enacted by the founding fathers of the United States Government. The Trust Law was created to prevent the government from seizing private property for their own private use, as was allowed under English rule.
What many people don’t understand is that without Eminent Domain it would be imposable to build straight freeways and develop growing cities.

There are a few complaints against Eminent Domain, however, that arise from some uses of the law. In an attempt to clean up the streets of major cities, the Eminent Domain can be used to force people out of blighted areas. Many people argue that this is an incorrect use of the law and draws away from strictly being for “public use”.
